HOW DO I PLACE AN ORDER ON BALLY WEBSITE?

It is easy and simple to place an order:

  • Look at our product categories and click on the images to get to the particular product page with information on sizes and materials.

  • Click on „ADD TO BAG“ to place the desired item in your shopping bag.

  • You can look at the selected items once more by clicking on „MY BAG“ on the top right of the website. If you would like to remove an item from your shopping bag, simply click on „REMOVE” next to the item concerned.

  • If you would like to select further items after looking at your shopping bag, click on „CONTINUE SHOPPING“.

  • To place your order, click on „GO TO CHECKOUT“ and follow the instructions.

  • Please note that the items in the shopping bag are not reserved and therefore can be purchased by other customers until you go to the checkout.

DO I NEED A CUSTOMER ACCOUNT TO BE ABLE TO PLACE AN ORDER?

You do not need to create an account to place an order. If you wish, you may also checkout as a guest. However, Bally recommends you create an account to be able to use the benefits of a customer account – such as save your address details, register your return autonomously, access to exclusive promotions and receive your birthday surprise.

I HAVE FORGOTTEN MY PASSWORD. WHAT SHOULD I DO?

You can reset your password by clicking on “Forgotten password?” on the login page and then following the instructions.

WOULD YOU LIKE TO PLACE AN ORDER WITH US?

Our experts can help you with an online purchase by phone or prepare the order according to your wishes. You can complete the order at a time convenient to you, depending on the availability of the goods. In both cases, you will receive an email with a link to the website, where you only need to enter the shipping and payment details to complete the purchase on your own. The same conditions apply to online orders on this website.

HOW DO I KNOW THAT MY ORDER HAS BEEN PLACED WITH YOU?

As soon you have completed your order, you get a confirmation by email from us. Please note that this does not confirm the acceptance of your order. After your details and the availability of the ordered items is confirmed, we send you a separate order confirmation. The contract between you and Bally becomes effective with the despatch of the item from our warehouse.

IS IT POSSIBLE TO PLACE A GIFT ORDER?

Yes, you can place a gift order by selecting the "Gift" option under the list of products in your shopping bag at checkout. You can either add a personal message or receive a blank card that you can add a message to later. It is also possible to hide the price for the recipient. IS PAYMENT BY CREDIT OR DEBIT CARD ON YOUR WEBSITE SECURE?

The security of your personal data is very important to Bally. To guarantee a secure purchasing experience and to protect your data transmitted via the Internet, Bally uses SSL (Secure Socket Layer) technology. All payment processes on the website are processed via Adyen, a secure online payment gateway, which encrypts your payment information in a secure host environment, and the second EU Payment Services Directive (PSD2), managed by the European Commission, a secondary form of identity authentication. Due to the requirements of the PSD2, it may be necessary to go through a verification step during the payment process when paying with a credit or debit card.

With Visa©, MasterCard© and American Express© credit cards, a 3D Secure process may be required. In this additional step, the identity of the cardholder is checked during the payment process and the online transaction is confirmed. Every bank has its own authentication procedure. WHEN WILL BALLY DEBIT THE PAYMENT AMOUNT FROM MY CARD OR MY ACCOUNT?

Bally only deducts the amount to be paid when your order is despatched from our warehouse. However, your card issuer / payment provider may secure the amount paid at the time of the order.

WHY HAS MY ORDER NOT BEEN ACCEPTED?

Please make sure that the address in your invoice field matches the address left with your bank. If the order is still not accepted, please contact your bank and then our customer service department via the contact form on the top of this page.

AM I ENTITLED TO A TAX REFUND FOR ONLINE PURCHASES?

Unfortunately, it is not possible for us to refund you accrued taxes for online purchases.

HOW LONG WILL I HAVE TO WAIT FOR MY ORDER?

After we have confirmed your order, the goods will reach you within 2 to 3 working days, depending on the selected shipping option. Please note: Our deliveries are made Monday to Friday between 7 AM and 7 PM. Delays could occur when processing your order during peak business hours, when there are promotions and at Christmas. WHAT ARE THE SHIPPING COSTS?

Bally offers free shipping for all orders over CHF 300. Shipping costs are CHF 15 for orders under CHF 300.

IS MY PACKAGE INSURED AND IS MY SIGNATURE REQUIRED ON DELIVERY?

Your order is insured by Bally during despatch until it arrives at your door. Receipt must be confirmed by signature upon receipt of the goods. The risk then passes to you when the goods are handed over.

CAN I TRACK MY ORDER?

As soon as your order has despatched, we send you an email with information about the courier service and a tracking number. With this number, you can track the progress of your consignment.

CAN I CHANGE MY DELIVERY ADDRESS AFTER THE ORDER HAS BEEN SENT?

Unfortunately, your delivery address can no longer be changed after the order has been placed.

CAN I HAVE MY ORDER SENT TO A FREIGHT FORWARDER ?

Please note that Bally does not ship to freight forwarders. Orders placed with a delivery to freight forwarders are automatically rejected and will not be processed.

CAN BALLY SHIP ORDERS TO PO BOXES?

Due to shipping restrictions, orders can unfortunately not be delivered to PO boxes.

RETURNS

HOW CAN I RETURN AN ITEM?

You can return products purchased on Bally.eu within fourteen (14) days from the delivery date, through our carrier TNT Fedex or by bringing them to a Bally store free of charge.
You can only return items within the same country the parcel was delivered.

A. In case you choose to return your order through TNT Fedex. Please, follow the steps below.

1. Activate your return:
•If you are a Registered user: access your account on www.bally.eu, visit the Returns History page and select the products that you would like to return. Fill the Online Return Form with the requested details, especially the return reason, and click on the button “ACTIVATE RETURN”. You will receive a confirmation E-mail once the return has been activated in our systems and a Return Authorization Number along with a link to arrange the pickup of the items at your convenience. Please note that the confirmation e-mail can take up to 48 hours to be sent.
•If you are a Guest user: contact our Client Services team by filling out the Online Contact Us form available on the top of this page. Bally Client Services will arrange our courier to collect the items at your convenience.

2. Prepare & dispatch the parcel:
Wrap up the goods you wish to return in the original box (or any other sturdy box). If you use the original packaging, please make sure to cover or remove any previous shipping label. The merchandise you return must be in its original condition, tags and packaging included, otherwise, we will be unable to accept your return and issue a refund.
Fill out the Return Form received with the order selecting the reason for your return and insert it inside the package. Please note that in case of multiple items you’ll find one form for each product.
Attach the return label to the top of the package and hand the package to the courier upon collection.
Please note: only returns shipped using our approved courier will be free of charge. Should you decide to use another courier, you will be responsible for all costs and liability. Any costs or expenses incurred by you are non-refundable.

3. Wait for the refund:
Once your package has arrived at our facility, the items will be inspected. If the items are deemed to be in new and unused condition with all tags and labels attached, Bally will issue a credit for the amount originally paid.
Once approved, the amount will be refunded on the original payment method used and depending on your financial institution, it may take up to 10 days for the refund to appear in your account.

B. In case you choose to return your order in a Bally boutique. Please, follow the steps below:
Check the nearest store (excluding Outlets, partnered retailers, and Airport stores) through the Store Finder on this website and bring the parcel to the store, one of our Client Advisor will start the procedure.
They will check the condition of the goods you are returning and the reason for the return.

HOW MUCH DOES THE RETURN COST?

All orders can be returned free of charge, unless it is otherwise prescribed in our General Terms & Conditions of Sale. You must follow the steps described for returning goods so that your items get to us safe and intact.

The refund is made to the card or via the same payment method used to purchase the goods, after the items have been inspected. As soon as the refund has been remitted, you get a confirmation by email from Bally.

Please note: Bally can only refund the purchase price to the card or via the same payment method used to purchase the goods. It can take up to ten days from the date of the return until the amount paid is remitted to your account statement or account, depending on the card issuer or payment provider.

CAN I RETURN MY ORDER IN STORE?

Yes, you have the option of returning orders made online to a store of your choice (except for outlets and airport stores). Please note that we accept returns in store only within the country in which the delivery took place. After receipt, you have fourteen (14) days to make a return request. All returned items must be returned in an unused condition and include all tags and labels. Bally will refund you the amount originally paid. Bally can only refund you the amount paid in the form of the original payment method you used. We will send you a confirmation email as soon as the refund has been made. CAN I EXCHANGE AN ITEM THAT WAS BOUGHT ONLINE?

Unfortunately, at present it is not possible for exchanges to be made for online orders. You can hand over the item in a store or have the item collected and we will refund the amount paid. CAN I RETURN A FAULTY ITEM?

You have the right to return faulty or defective goods.

If you establish manufacturing faults or defects in the items, please get in touch with our customer service department directly via the contact form on the top of this page.

Our customer service department will give you precise instructions for returning the items.

The items are inspected for damage or defects immediately on arrival and, in given cases, repaired or replaced. Should we not be able to repair or replace an item, we will refund you the full purchase price.

Please note: If the items prove not to be faulty, damaged or defective or the damage can be attributed to improper handling, your entitlement to repairs or replacement ceases to apply and Bally will return the items at your cost and risk.

What is the difference between an adjustable or fixed belt buckle?

Bally has two types of belt constructions – adjustable and fixed. If your belt has a fixed belt buckle, it has multiple size options to choose from. If your belt is adjustable, it is designed in one length. The buckle can be removed to shorten the belt to the desired fit. Bally offers a belt adjustment service in every store. Our delivery times are 3 to 5 working days. Bally offers free shipping for all orders over €300.

Please note that delivery times are calculated from the time we despatch your order, not the time the order was placed. As soon as your order has been despatched, you receive a confirmation of despatch by email and via your Bally account.

1.1 As a consumer, you can cancel your contract with regard to products which were purchased on the website without a contractual penalty by notifying the customer service department through the contact form on the top of this page. Returns queries must reach us within fourteen (14) days of delivery of the goods.

1.2 Bally provides a service for all returns, whereby returns are picked up by the carrier. Only returns that are carried out by the courier confirmed by us are free of charge and Bally bears the costs and liability for the same.

1.3 Should you decide to use a different carrier than that set in advance by Bally, you bear all the associated costs and liability. Costs and expenditure that you incur on returning products are not refundable. In the event the package is lost by the courier of your choice, Bally is neither responsible for this loss nor will it make a refund.

1.4 Please send back the products within 7 (seven) working days from the day you receive the returns identification number from Bally.

1.5 You should pack the product(s) appropriately and securely when returning it/them. You should return the product(s) in the same condition you received it/them and it/they should be returned in the original packaging; in addition, the products should not have been washed or damaged and the relevant label should be attached to the product together with the seal. Please note that returned products are subject to a quality control inspection. If the products have been returned in impeccable condition, new, and with all the tags and labels intact, Bally confirms the return and refunds you the original price paid. In the event that the recipient of the product/products given on the order form does not match the person who paid for this product(s), the amount paid for the returned product(s) is refunded to the person who paid for the product(s).

1.6 Otherwise, if tags or labels are missing, if the return does not comply with Bally’s T&Cs or Bally has reason to believe that the products have been altered or the products were fakes or were not purchased directly on the website, Bally does not accept the return and sends the products back to you.

1.7 Should Bally accept your return, we will give you a refund for the product(s). Bally will make the refund to the account/payment method used originally to complete the payment as soon as the products have reached our warehouse. Should you decide to use a different courier from the one provided by Bally, we could withhold repayment until we receive the products or until you send us proof that you have sent the products, whichever of the two reaches us fastest.

1.8 You can also return the products within the country in which the delivery took place to stores that belong to Bally or are directly run by Bally. We are not able to accept returns for purchases that were made in franchise stores, outlets, shops, warehouses, duty-free shops or on another website.

1. OUR BUSINESS PRINCIPLES

1.1 Bally offers its products for sale on the website, including electronic commercial services, exclusively to consumers, i.e. any natural person who acts for purposes outside of their commercial and business activity or profession. If you are not a consumer, please do not purchase any product(s) on the website. We reserve the right not to process orders placed by users who are not consumers, as well as other orders that do not agree with our business principles.

1.2 Bally only offers its products to consumers who are over 18 years of age. If you are under 18 years of age, you are strictly forbidden to order products from our website. Bally reserves the right to cancel orders from consumers whom we believe to be under 18 years of age.

1.3 We do not sell any second-hand products, faulty products or products that are of a lower quality than the corresponding standard available on the market. The important features of products are shown on the website and the particular product page. Regardless of your web browser or the quality of your monitor, the products offered for sale on the website might not correspond to the actual products with regard to appearance, dimensions and colours.

1.4 Products ordered on this website can only be delivered within Switzerland (the “destination country”). Further information can be found in subsection 4 of these T&Cs.

2. ORDER PROCESS AND STEPS FOR COMPLETING CONTRACT

2.1 To place an order, you must select the products you would like to buy on the website, select a size and add the items to your shopping bag by clicking on “Add to bag”. When you are ready to go to the checkout, click on the shopping bag symbol on the top right of your monitor, where all the products you have selected for purchase are shown. You have the opportunity to check the details of your order once more and to notice and edit errors by using the delete and edit features. You are responsible for checking that the right number of products are in your shopping bag and that the products in your shopping bag are the right style, right colour and right size before you continue. When you are ready to continue with your order, click on “Secure payment”, where you have the option of adding gift options and are requested to select your preferred payment method and delivery option as well as being asked to enter your personal information and, after you have read and accepted these T&Cs, click on the acceptance button. You are requested to log in to your personal account (if you are already registered) or continue to the guest checkout. By clicking on the ‘confirm purchase’ button, you make a binding offer for the purchase of the selected products from Bally.

2.2 All orders are subject to acceptance and availability. Please be aware that products in your shopping bag are not reserved and therefore can be purchased by other users until you have fully completed the checkout process.

2.3 Your order is an offer to Bally to buy the product(s) contained in your order, which you are committed to for a period of 15 (fifteen) days. An order is considered to be transmitted to Bally when you receive an (automatically generated) order confirmation email that confirms the contents of your order, how it was entered and processed.

2.4 This order confirmation email is merely confirmation of the fact that we have received your order but it does not confirm acceptance that you can purchase your order.

2.5 Your offer is considered accepted and the relevant purchase contract comes into force from the moment Bally despatches the product and you receive a confirmation email containing information about the acceptance of your order, the time of sending, important features of the purchased products, a detailed breakdown of the price paid for each product, as well as delivery costs and details (“Update of order status").

2.6 If your order is sent in more than one package you might receive a separate email for each package and with each separate email we conclude a separate sales contract for the product(s) named in these emails.

2.7 You can access your order form by clicking on the area with the name My Account, Check Order Status.

2.8 Bally reserves the right not to accept your order at its own discretion. In this case, Bally will notify you of the cancellation of the order by email.

2.9 By sending your order, you accept these T&Cs, as well as other conditions provided on the website (including the Privacy Policy, Returns Policy and Warranty Policy), and declare that you will comply with these terms.

2.10 We expressly invite you to print a copy of these T&Cs and the order form via the print option as well as to save a copy of these documents for your personal use.

3. PRICES AND PAYMENT

3.1 All prices given on the particular product page include applicable taxes. We reserve the right to change prices. However, such changes do not affect the price or the description of products for which you have already placed an order.

3.2 Although every reasonable care is taken to ensure the prices given on the website are correct at the time of their publication, a small number of products can be displayed on our website with the wrong price. Prices are then confirmed when you receive an order confirmation email showing the various costs (including delivery).

3.3 You can pay for your order using the payment methods available on the website, e.g. credit/debit card.

3.4 We take all reasonable care to make our website secure. All credit/debit card transactions on our website are processed via Adyen, a secure online payment portal, which encrypts your card details in a secure host environment. This information is fully encrypted and only used to process card transactions you have prompted to get a refund in the case of a return or non-availability of products or, in the case of fraud, to report the incident to the police. 3D Secure is a procedure with which Bally guarantees the security of online payments for the credit cards designed for this purpose by Visa©, Mastercard© and American Express©. In this additional step, the identity of the cardholder is checked during the payment process and the online transaction is confirmed. Every bank has its own authentication procedure. 3.5 Should it not be possible to make your payment, please check that all the information you have transmitted is correct and execute the transaction again. Should the problem persist, please contact your card issuer directly as, unfortunately, Bally cannot help you with this type of payment error.

3.6 The payment is “reserved” or “frozen” by your card provider as soon as you try to make a purchase on the website or actually do so. The price for the purchase of products and the relevant costs for despatch and delivery as shown in the order confirmation email are only taken from your selected payment method once the purchased products are actually despatched. Orders made on your behalf will be charged immediately, regardless of whether the items are in stock or will be delivered at a later date

3.7 To ensure that your credit or debit card is not used without your consent, Bally validates your name, address details and other personal information provided by you when placing the order via facilities offered by Adyen.

3.8 Bally reserves the right to implement additional and/or other payment security systems from time to time.

3.9 Refunds of a payment received from you, no matter why they are made, are made via the same payment method you selected during the checkout process and which cannot be changed once the order is placed. Bally is not responsible for delays that are outside of Bally’s control, including delays caused by the selected payment/refund method or originating in the card issuer.

4. SHIPPING AND DELIVERY

4.1 Depending on the local guidelines for logistics providers, delays may occur due to the global COVID-19 situation in your region. We apologise for any inconvenience caused.

4.2 Delivery of products from this website is limited to Switzerland.

4.3 Bally is not able to deliver to addresses such as PO boxes or forces’ postal services. Orders with these delivery details are automatically cancelled.

4.4 As soon as the status of your order has changed to “despatched”, the order status is updated and contains information about the courier and the relevant tracking number(s).

4.5 At present, the couriers used by Bally are only able to deliver Monday to Friday (except for statutory bank holidays) during usual business hours in the destination country.

4.6 All consignments require a legible customer signature on delivery.

4.7 On delivery, it is the responsibility of the customer to check that the package which they signed for is undamaged, has no visible changes and is not wet. All defects of this kind should be mentioned on the delivery note (as soon as you sign for the delivery).

4.8 In the event of us not being able to deliver the ordered items within 30 days of conclusion of the contract, you are entitled to dissolve the contract and demand a full refund of your order.

4.9 After full and correct payment, delivery and signing for the package, ownership of the products is transferred to you and you take over full responsibility for the products.

4.10 If the option “Collect in-store” is selected, the Bally Store will have the purchased products ready in-store in a classic Bally carrier bag, if necessary. If you select the option “Collect in-store”, you declare that you agree to the Bally Store opening the package in-store so that the products can be prepared appropriately for collection.

5. RIGHT OF CANCELLATION/RETURNS POLICY

5.1 As a consumer, you can cancel your contract with regard to products which were purchased on the website without a contractual penalty by notifying the customer service department through the contact form on the top of this page. Returns queries must reach us within fourteen (14) days of delivery of the goods.

5.2 You will find further information on your right of cancellation, conditions and further explanations on how to exercise your rights in the right of withdrawal guidelines and the <u><a href='#returns'>Returns Policy</a></u>.

6. WARRANTY FOR DEFECTS

6.1 You are entitled to the statutory rights of warranty for defects. Bally will only pay compensation for damage and futile expenses based on a material defect within the limits defined in clause 8.

6.3 In the event of a refund of the purchase price, Bally refunds the purchase price and the costs of returning the faulty product by means of the same payment method that you used originally to pay for purchase. If the recipient of the products given on the order form does not match the person who paid for these products, the amount paid for the returned products is refunded to the person who paid for the products.

WARRANTY POLICY

1.1 Bally guarantees the consumer for a period of twenty-four (24) months from the delivery date that products correspond to specifications and are free from material and manufacturing defects.

1.2 This warranty applies not only to products that a) are manufactured by or for Bally and are identifiable as such by fixed legitimate “Bally” trademarks, company name or logo and b) were bought by consumers on this website.

1.3 If a product shows a manufacturing fault or there exists a supposed deviation of the product from the contractual composition, the consumer must notify customer service through the contact form on the top of this page to claim their warranty rights. This notification must be made within two months of the time a defect of this kind is established. In any event, the time limit for the procedure to claim a defect which has not been fraudulently covered up by Bally shall expire 26 months after delivery of the products.

1.4 The product must be sent back within 15 (fifteen) working days of notifying Bally of the damaged or faulty product.

1.5 Bally checks the returned, damaged or faulty product and in the presence of a breach of contract will replace it or, if this is not possible, refund the purchase price.

1.6 Bally will refund the purchase price and the return costs of the product by the same payment method used to make the purchase. If the recipient of the product on the order form is different from the person paying, the amount paid for the returned products is refunded by the seller to the person who made the payment.

1.7 In the event that Bally fails to establish a defect in the returned products, you will be notified that the product cannot be taken back. You then have the option of deciding whether the products should be sent back to you again. If you do not agree to the delivery, Bally reserves the right to retain the products and the purchase price.

1.8 This warranty does not apply (i) if the product was subjected to wrong or improper use or repairs or alterations and/or modifications were made that are not covered by the product documentation; (ii) damage caused by not following the usage instructions in the product documentation or other definite instructions by Bally; (iii) if the product has been damaged through wrong use, misuse, neglect, accident, normal wear and tear, improper environmental conditions or lack of care; (iv) for damage based on reasons other than faulty design, manufacture and/or materials.
